General terms and conditions
The following general terms and conditions apply to all contracts concluded between the seller Enjoy Life s.r.o., (hereinafter referred to as “Seller”) and consumers or entrepreneurs (hereinafter referred to as “Buyer”) concluded on the website https://rayofsmile.com with regard to the goods presented by the Seller in the version valid at the time of the order.
The consumer is any natural person who completes a legal transaction for purposes which are largely not attributable to their commercial or independent professional activity. An entrepreneur is a natural or legal person or a legal entity which, when concluding a legal transaction, acts in the exercise of its commercial or independent professional activity.
These General Terms and Conditions shall also apply to all current and future contracts, deliveries and other services of the Seller vis-à-vis entrepreneurs without separate inclusion.
Any terms and conditions of the Contractor which conflict with or deviate from these General Terms and Conditions are hereby rejected and shall only be deemed to have been agreed between the Seller and the Contractor if the Seller expressly agrees to their validity in writing.
2.1 The essential characteristics of the goods offered by the Seller and the period of validity of limited offers are set out in the individual product descriptions on https://rayofsmile.com.
2.2 The product descriptions contained in the online shop of the seller do not represent binding offers on the part of the seller, but serve to submit a binding offer by the customer.
2.3 The Customer may submit the offer via the online order form integrated into the Seller’s online shop. In doing so, after placing the selected goods in the virtual shopping cart and going through the electronic ordering process, the customer submits a legally binding contractual offer with regard to the goods contained in the shopping cart by clicking the button that concludes the ordering process.
2.4 The Seller may accept the Customer’s offer within five days,
– by sending the customer a written order confirmation or an order confirmation in text form (fax or e-mail), in which case the receipt of the order confirmation by the customer is decisive, or
– by delivering the ordered goods to the customer, in which case the receipt of the goods by the customer is decisive, or
– by requesting payment from the customer after the customer has placed the order.
If several of the aforementioned alternatives exist, the contract shall be concluded at the time when one of the aforementioned alternatives occurs first. The period for the acceptance of the offer begins on the day after the sending of the offer by the customer and ends with the expiry of the fifth day following the sending of the offer. If the Seller does not accept the Customer’s offer within the aforementioned period, this shall be deemed to be a rejection of the offer with the consequence that the Customer shall no longer be bound by its declaration of intent.
2.5 When submitting an offer via the Seller’s online order form, the text of the contract shall be stored by the Seller after the conclusion of the contract and transmitted to the Customer in text form (e.g. e-mail, fax or letter) after the Customer’s order has been sent. The Seller shall not make the text of the contract accessible beyond this.
2.6 Before placing a binding order via the Seller’s online order form, the Customer can identify possible input errors by carefully reading the information displayed on the screen. An effective technical means for better recognition of input errors can be the enlargement function of the browser, with the help of which the display on the screen is enlarged. The customer can correct his entries during the electronic ordering process using the usual keyboard and mouse functions until he clicks the button that concludes the ordering process.
2.7 Order processing and contacting usually take place via e-mail and automated order processing. The customer must ensure that the e-mail address provided by him for order processing is correct, so that e-mails sent by the seller can be received at this address. In particular, when using SPAM filters, the customer must ensure that all e-mails sent by the seller or by third parties commissioned by the seller to process the order can be delivered.
2.8 Technical steps of the ordering process When ordering via the Seller’s online shop, the ordering process includes the following technical steps. First, the Buyer selects the desired product by clicking on the “Add to shopping cart” button. The products in the shopping cart are then displayed to the Buyer. The products in the shopping cart can be deleted by clicking on the “Remove” button. By clicking the buttons “+” and “-” the buyer has the possibility to change the number of selected products. In order to complete the order, it is necessary for the Buyer to confirm the Seller’s General Terms and Conditions and to take note of the cancellation policy by placing a tick in the boxes provided for this purpose. By clicking the button “checkout” the buyer gets to the next step of the ordering process “customer information”. After the buyer has entered his name, his address including billing address and, if applicable, a different delivery address as well as his e-mail address in the fields provided for this purpose, he is taken to the next step of the ordering process “Shipping” by clicking on the button “Continue to shipping method”. Only the free standard shipping can be selected here. By clicking on the button “continue to payment method”, the Buyer is taken to the next step of the ordering process “Payment”. After the Buyer has decided on a payment method offered by the Seller, namely “Credit Card”, “Paypal”, “Stripe” and has selected these accordingly, he reaches the order overview page “Check Order” by clicking on the button “Check Order”. On the order overview page, the Buyer has the opportunity to check the data required for the order, the selected payment method and the selected products once again before he completes the order by clicking the “Buy now” button.
When selecting the payment method “Paypal”, the buyer arrives by clicking the button “Buy Now” on the website of Paypal and after entering his login data and payment process is automatically redirected to the order overview page of the Internet shop of the seller.
The contract language is English and German.
The text of the contract is stored by the seller himself and made available to the buyer by the seller himself before the conclusion of his order and sent again by e-mail after the conclusion of the contract. The TOS and AGB can be seen and downloaded by the buyer at any time on this side. The buyer can view past orders in his customer account.
5.1 Consumers are entitled to the statutory right of revocation in accordance with the seller’s revocation instructions.
5.2 The right of withdrawal does not apply to distance contracts for the delivery of sealed goods which are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery.

6.1 The prices quoted by the Seller include the applicable statutory value-added tax and are final prices plus any additional shipping costs. The costs for packaging and shipping are listed on the website “Terms of delivery and payment“shown separately.

6.2 The following payment options are available to the buyer in the seller’s online shop:
If the buyer chooses the payment method PayPal, the buyer pays the purchase price via the payment service PayPal (Europe) S.à r.l. et S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg.

If the buyer already has a PayPal account with PayPal, the buyer will be redirected to PayPal and after entering his access data for the buyer’s PayPal account must confirm the payment order to the seller there. If the buyer does not have a PayPal account, the payment can be made after forwarding to PayPal via the function “Payments without PayPal account”. 7.1 Unless otherwise agreed, the goods shall be delivered by shipment to the delivery address specified by the Buyer in the ordering process.

7.2 The goods shall be delivered to the address indicated on the “Terms of delivery and payment“and the shipping costs and delivery times stated in the product description. 

7.3 Possible customs duties or local taxes must be borne by the buyer.
The goods remain the property of the seller until payment has been made in full.
The warranty is governed by the statutory provisions.
In the case of delivered goods with obvious transport damage, the buyer is asked to complain immediately to the deliverer and to inform the seller of this. If the buyer fails to make a complaint or contact us, this will have no effect whatsoever on the existence of the statutory warranty rights.
The seller excludes his liability for slightly negligent breaches of duty, provided that these do not concern damages from injury to life, body or health or guarantees or claims due to fraudulent misconduct or under the Product Liability Act are relevant. Furthermore, the liability for the breach of obligations, the fulfillment of which is essential for the proper execution of the contract and on the observance of which the purchaser may regularly rely, remains unaffected. The same applies to breaches of duty by the legal representatives or vicarious agents of the seller.

The EU Commission provides an Internet platform for the online settlement of disputes (the so-called “OS platform”), which can be accessed under http://ec.europa.eu/consumers/odr/ is reachable.

The seller is neither willing nor obliged to participate in dispute resolution proceedings before a consumer mediation body.
The seller has not submitted to a special code of conduct.
14 Customer service
The seller does not offer any customer service beyond the processing of statutory warranty claims.
15.1 Should any provision of these General Terms and Conditions be invalid, the remainder of the contract shall remain valid. Instead of the invalid provision, the relevant statutory provisions shall apply.
15.2 If the purchaser is an entrepreneur, German law shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods.
The seller does not offer any customer service beyond the processing of statutory warranty claims.
If the Buyer is a merchant within the meaning of the German Commercial Code, a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from contractual relationships between the Seller and the Buyer shall be the Seller’s place of business.
